Acceptable Use Policy and Sanctions Policy
What is prohibited on the UA-Pro platform, how we handle complaints, and what leads to access suspension
1. Purpose of these Rules
UA-Pro is a platform where real businesses serve real customers. Customer trust in the platform is a shared asset of all Users acting in good faith; therefore, order here is a condition of access, not a mere aspiration.
These Rules form an integral part of the Public Services Agreement and have the same binding force. Capitalised terms are used with the meanings assigned to them in the Agreement.
2. Prohibited Activities and Content
It is strictly prohibited to list, offer or advertise:
- goods and services whose circulation is prohibited or restricted by law: narcotic drugs, psychotropic substances and precursors, weapons, ammunition, explosives, poisons, radioactive materials;
- prescription-only medicinal products and medical devices without the appropriate licence, as well as products of unproven efficacy presented as having therapeutic properties;
- counterfeit, pirated or stolen goods, as well as goods infringing the intellectual property rights of third parties;
- services of a sexual nature, pornographic material, or any material involving minors;
- services connected with human trafficking, forced labour, illegal migration or the forgery of documents;
- financial pyramid schemes, "quick earnings" schemes, guaranteed returns, unlicensed betting and gambling, or exchange transactions involving crypto-assets that do not comply with the requirements of applicable law;
- material containing incitement to violence or terrorism, or incitement to hatred on grounds of race, ethnic origin, religion, sex, age, disability or sexual orientation;
- material justifying armed aggression against Ukraine or disseminating hostile propaganda;
- live animals in breach of animal welfare legislation, or species whose circulation is restricted;
- personal data of third parties without a legal basis, contact databases, or services for the unauthorised "look-up" of information about individuals;
- any activity that violates sanctions restrictions (Section 17 of the Agreement).
3. Accuracy of Information
It is prohibited to:
- state inaccurate prices, conceal mandatory surcharges, or display a "price from" that does not exist in reality;
- present other persons' photographs of work, premises or goods as one's own;
- create, commission or incentivise false reviews and ratings, whether positive for oneself or negative for competitors;
- impersonate another person or brand, or hold oneself out as an official representative without authority;
- claim qualifications, certificates, education or experience that one does not possess;
- disguise advertising as editorial or customer-generated content;
- artificially inflate activity metrics, or manipulate views, bookings or enquiries.
Information on opening hours, address, range of services and prices must be kept up to date. Repeated customer no-shows caused by outdated information shall be treated as a violation.
4. Licences, Permits and Professional Requirements
Where an activity is subject to licensing or certification or requires specialised education (medical and dental services, cosmetology involving injectable procedures, veterinary medicine, psychotherapy, legal and financial services, transport, food services, tourism, security services), the User must hold valid permits and authorisations and provide them upon the Company's request.
Food establishments must comply with food safety requirements and allergen labelling rules. Accommodation providers must comply with check-in and guest registration rules. Employers must comply with labour law and the requirements for non-discriminatory job advertisements.
The Company is entitled to suspend the publication of a profile pending confirmation of the permits and authorisations. This does not constitute a verification of the quality of the User's services and does not make the Company liable for them.
5. Technical Restrictions and Security
It is prohibited to:
- obtain or attempt to obtain unauthorised access to the Platform, other users' Accounts or data;
- carry out automated data collection (scraping), mass copying of the catalogue, or the creation of derivative databases;
- place excessive load on the infrastructure, carry out denial-of-service attacks, or circumvent limits and protective mechanisms;
- probe for vulnerabilities without the Company's written consent, except for reporting a discovered vulnerability in good faith to legal@ua-pro.com;
- distribute malicious software, phishing links, or spam through the Platform's communication channels;
- use the Platform to send mailings to persons who have not consented to them;
- register accounts to circumvent previously imposed sanctions, including in the names of other persons.
6. Interaction with Customers and Colleagues
- honour confirmed bookings and orders, or give timely notice if you are unable to fulfil them;
- do not divert payment outside the agreed terms where this misleads the customer as to the price;
- do not use customer contact details obtained through the Platform for purposes unrelated to providing the service, without their consent;
- do not engage in offensive, discriminatory or threatening communication — whether towards customers or towards the Company's employees;
- resolve disputes with customers in good faith: refund payments where the law so requires, and record agreements in writing.
7. How to Report a Violation
Send notices of illegal Content or violations of these Rules to abuse@ua-pro.com. Please state: a link to the page or profile, the substance of the violation, why the Content is illegal or inaccurate, your contact details, and a confirmation that the notice is submitted in good faith. Attach evidence if available.
We process notices in a timely, diligent, non-arbitrary and objective manner, inform the notifier of the outcome and of the available means of redress. Notices submitted by trusted flaggers are processed with priority. This procedure complies with Articles 16, 17 and 22 of Regulation (EU) 2022/2065.
Knowingly false notices constitute misuse: in the event of systematic submission of manifestly unfounded complaints, we may temporarily suspend the processing of notices from that person.
8. Sanctions for Violations
The measure is chosen depending on the gravity and recurrence of the violation, the intent, and the harm caused. The Company applies a proportionate measure, not necessarily the most severe one.
- Warning with a requirement to remedy the violation within a specified period;
- Removal or hiding of Content, withdrawal of an individual listing from display;
- Reduction of visibility of the profile in the Platform's search results;
- Restriction of functions: prohibition on publishing new content, restriction of communication, suspension of promotion;
- Suspension of the Account for the duration of an investigation or until the violation is remedied;
- Termination of the Agreement and blocking of access ("ban") with removal of the User's public pages.
In the event of repeated violations after a previously applied measure, the provision of services may be terminated permanently, including refusal to register new accounts of related persons (Article 23 of Regulation (EU) 2022/2065).
The Company transmits information and materials to the competent authorities where there is a suspicion of a criminal offence, in particular one involving a threat to the life or safety of persons.
9. Notification of Decisions and Appeals
We shall notify the User of any measure applied, specifying: the Content or feature it concerns, the grounds for the decision, whether it was taken by automated means, and the procedure for appeal. No notification shall be sent where this is prohibited by law or would prejudice an investigation.
An appeal shall be submitted within 30 days to abuse@ua-pro.com, together with a statement of grounds and supporting evidence. The decision shall be reviewed by a human, not by an automated system. The review period shall, as a rule, not exceed 14 days. If the appeal is upheld, the measure shall be revoked, the Content shall be restored, and the term of any paid Subscription shall be extended by the duration of the restriction.
The User may also apply to out-of-court dispute settlement bodies or to a court in accordance with the procedure set out in Section 21 of the Agreement.
10. Amendments to the Rules and Contact Details
The Rules shall be amended in accordance with the procedure set out in Section 19 of the Agreement: business users shall be notified no less than 15 days before the amendments take effect, except for amendments required by law or for security reasons.
